GOWLDN™ TERMS AND CONDITIONS

These Terms and Conditions (“Terms”) govern the purchase and use of digital GPS routes (“Routes”) provided by Gowldn™ (referred to as “Gowldn™”, “we”, “us”, or “our”). By purchasing, downloading, or using any Route, you (“User”, “you”, or “your”) agree to be bound by these Terms.

If you do not agree, you must not purchase or use our Routes.

1. NATURE OF THE SERVICE

1.1 Gowldn™ provides digitally designed GPS routes intended for recreational running and cycling purposes.

1.2 Routes are provided “as is” and are based on mapping data available at the time of creation.

1.3 Gowldn™ does not guarantee that any Route will be uninterrupted, safe, accessible, suitable, or free from hazards.

2. USER RESPONSIBILITY AND SAFETY

2.1 You acknowledge that running and cycling on public roads and pathways involve inherent risks, including but not limited to:

Traffic hazards
Road defects
Weather conditions
Pedestrians and other road users
Unexpected obstacles or incidents

2.2 You accept full and sole responsibility for:

Your personal safety
Your route choices while following or deviating from any Route
Compliance with all applicable laws, including the Highway Code
Assessing road, traffic, and environmental conditions in real time

2.3 You must exercise independent judgement at all times. You must not follow a Route blindly where doing so would be unsafe or unlawful.

2.4 Gowldn™ strongly recommends that you:

Remain alert at all times
Avoid using devices in a way that distracts from safe navigation
Wear appropriate safety equipment

3. ROAD CONDITIONS AND ROUTE VARIATIONS

3.1 You acknowledge that:

Roads, paths, and access points may change at any time
Roads may be closed without notice
Construction, events, or emergency situations may affect accessibility

3.2 Where a Route becomes partially or wholly unusable, you are solely responsible for:

Identifying safe alternative paths
Rejoining the Route where appropriate

3.3 Gowldn™ has no obligation to update Routes in real time or notify you of changes.

4. DISCLAIMER OF LIABILITY

4.1 To the fullest extent permitted by law, Gowldn™ excludes all liability for any loss, damage, injury, or death arising out of or in connection with:

Use of any Route
Inability to use any Route
Errors or inaccuracies in Route design
Changes to roads, paths, or conditions
Actions taken by you or third parties

4.2 This includes, but is not limited to:

Personal injury
Property damage
Financial loss
Indirect or consequential loss

4.3 Nothing in these Terms excludes or limits liability where it cannot be excluded under UK law, including:

Death or personal injury caused by negligence
Fraud or fraudulent misrepresentation

4.4 Subject to clause 4.3, Gowldn™’s total liability to you shall not exceed the amount paid for the Route.

5. NO WARRANTY

5.1 All Routes are provided without warranties of any kind, whether express or implied.

5.2 Gowldn™ does not warrant that:

Routes will be safe or suitable for your fitness level
Routes will be uninterrupted or error-free
Routes will achieve any specific result

6. PURCHASES AND REFUNDS

6.1 All purchases are final.

6.2 Due to the digital nature of the product:

No refunds, cancellations, or exchanges will be provided once a Route has been delivered
You waive any statutory cooling-off period to the extent permitted by law upon download or access

7. INTELLECTUAL PROPERTY

7.1 All Routes and associated content are the intellectual property of Gowldn™.

7.2 You are granted a non-exclusive, non-transferable licence for personal use only.

7.3 You must not:

Reproduce, distribute, or sell Routes
Share Routes and associated Route guides publicly or commercially
Modify Routes for redistribution

8. FITNESS AND MEDICAL DISCLAIMER

8.1 You confirm that you are physically able to undertake the activity.

8.2 Gowldn™ is not responsible for any health issues arising from use of the Routes.

8.3 You should seek medical advice before engaging in physical activity where appropriate.

9. INDEMNITY

9.1 You agree to indemnify and hold harmless Gowldn™, its owners, affiliates, and partners from any claims, damages, liabilities, or expenses arising from:
